1. Who we are
These Terms of Service ("Terms") govern your use of www.allamericafixandservice.com (the "Site") and the calls and text messages described below. The Site is operated by ALL AMERICA FIX AND SERVICE LLC, a Florida limited liability company ("All America", "we", "us"), 300 Biscayne Blvd, Apt 3503, Miami, FL 33131. By using the Site or opting in to our messages, you agree to these Terms. If you do not agree, please do not use the Site.
2. Our services
All America provides custom software, systems integration, complex system implementation, AI services, growth operations, managed platforms and related consulting for businesses. Information on the Site is general and is not an offer. Any paid engagement is governed by a separate written agreement or statement of work, which controls if it conflicts with these Terms.
3. SMS / text messaging terms
Program name: All America Fix and Service — Customer Messages.
What we send: service updates for customers who requested service: replies to your request, scheduling, appointment reminders, technician arrival updates and callbacks after a missed call. We do not send marketing or promotional text messages.
Frequency: Message frequency varies.
Cost: Message and data rates may apply.
Opt out: Reply STOP to any message to stop receiving texts. You will receive one final message confirming you have been unsubscribed. You may also reply CANCEL, END, QUIT or UNSUBSCRIBE. To resume, reply START.

Consent is not a condition of purchase. You do not have to agree to receive texts in order to buy anything from us.
Carriers are not liable for delayed or undelivered messages.
How you opt in
You opt in by checking the text-message box on our contact form, or by agreeing when we ask you on the phone. The box is not pre-checked and is optional. When you opt in we keep a record of your choice, the wording you agreed to, the date and time, the page you were on, your IP address and your browser type, so that we can show when and how consent was given.
Automated, AI-assisted and prerecorded messages
If you opt in, calls and texts may be sent using automated technology, may be drafted or answered with the help of AI tools, and may include prerecorded voice. A person on our team is responsible for these messages and you can ask to speak to a person at any time.
Your number
You confirm that you are the subscriber of the mobile number you provide or are authorised by the subscriber to use it, and that you are at least 18 years old. Please tell us if you give up or change the number so that we stop texting it.
How we handle your mobile number and consent is described in our Privacy Policy. We do not sell, rent or share your mobile number or SMS opt-in consent with third parties or affiliates for their marketing purposes.
4. Phone calls
Calls with us may be recorded and transcribed for quality, training and record-keeping. We will tell you at the start of a call when it is being recorded.
5. Use of the Site
You agree not to misuse the Site, including by attempting to gain unauthorised access, interfering with its operation, submitting false information or using it to send spam. We may suspend access to anyone who does.
6. Intellectual property
The Site, including its text, design, logos and code, belongs to All America or its licensors. You may view it for your own information; you may not copy or reuse it commercially without our written permission.
7. Disclaimers and limitation of liability
The Site is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, about the Site, and we are not liable for indirect, incidental, special or consequential damages arising from your use of the Site or our messages. Nothing in these Terms limits liability that cannot be limited by law.
8. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute about the Site will be brought in the state or federal courts located in Miami-Dade County, Florida, unless applicable law requires otherwise.
9. Changes
We may update these Terms from time to time. The effective date above shows when they last changed. Material changes to the SMS terms will not apply to you without notice.
